National Summary

This topic covers the Americans with Disabilities Act (ADA), including the ADA Amendments Act of 2008 (ADAAA), as well as the Genetic Information Nondiscrimination Act (GINA) and the Lilly Ledbetter Fair Pay Act of 2009.

The ADA prohibits private employers with 15 or more employees from discriminating against a qualified individual with a disability. Covered employers must provide reasonable accommodations to such individuals unless these accommodations would impose an undue hardship on the operation of the employer’s business. Accommodations can include adjustments to job tasks and the working environment as well as provisions for assisting individuals with disabilities during emergencies and evacuations.
